This Phase Two Development Site is Located
To The West Of Cookstown Enjoying Large Road Frontage
And Is A Short Distance From The Town Centre,
With The Main Sewer System Close By.
Conditions of Sale
1 The Sale shall
proceed on an unconditional basis and shall not
be subject to matters such as finance, planning
etc. (save for the issue referred to at 2 below)
2 The sale shall
be conditional upon rights being granted to the
vendors, the registered owners of the lands hatched
green & orange on the map annexed hereto,
in respect of a right of way to facilitate any
future development with or without vehicles from
the said lands across the lands in sale to Orritor
Road by means of a road way constructed to DOE
Roads Service specifications together with the
right to lay, install and maintain all relevant
services in, over, under and through the said
lands and together also with all necessary visibility
splays and internal alignments to facilitate eventual
adoption of the said road way by the statutory
authority. Site Lines if required will be granted
over the Area Hatched Blue on the Map Annexed
Hereto. The vendors reserve easement to service
the existing septic tank and all water and drainage
pipes across the land in sale. The owner of the
lands at development stage to erect a 6ft high
wooden fence on the boundary to the rear of the
development to restrict access to adjoining farmland.
3 An initial deposit
of £50,000 shall be payable by the Purchaser
to the Vendor on the verbal acceptance by the
Vendor of the Purchaser’s offer to purchase,
such deposit to be non-refundable in the event
that the sale does not proceed for any reason
other than the act or default of the Vendor.
4 The Purchaser
shall sign a contract within 1 month of the sale
being agreed and shall complete the transaction
no later than two months thereafter.
